Mediation
is a proven and successful process in which a neutral person
facilitates communication between two or more parties in disagreement.
The mediator can help the parties to resolve the issue in a way that is
acceptable to everyone. Mediation is both voluntary and confidential
and is designed to be a safe place for all parties to be heard and to
discuss the issues openly and honestly.
Approximately 90% of all
mediations at CRC ended in some form of agreement, with 96% of
individuals saying mediation was helpful and that they would use the
process again. Ninety-Eight percent of participants said that they
would recommend mediation to others. This means that even participants
that did not reach an agreement in mediation, felt that the process was
helpful in their situation. Click HERE to see what our past clients have said about their experience at the Conflict Resolution Center.
Mediation can help bring a resolution to nearly any dispute including:
Divorce or Separation
Workplace disputes
Family disputes such as child custody, visitation, and/or child support
Neighborhood and housing disputes
Landlord/Tenant disputes
Business/Consumer disputes
Parent/Teen disputes
Elder Care disputes
The mediator's role is to:
Create a safe environment for discussion
Provide the opportunity for both people to be heard
Help people identify the important issues
Encourage people to think creatively about solutions
Write the agreement in plain English so both people can understand the agreement
During
a mediation session each party is given the opportunity to describe the
conflict from their point of view. The mediator then helps each party
understand the other person’s point of view so that the parties can
begin to work together. The parties are asked for their ideas as to
how to resolve the conflict, giving all parties control over the
outcome. When the parties come to an agreement the mediator can create
a legally binding document.
Fees for mediation vary depending on the individual case, but usually range from $15—$120 per hour.
The
Conflict Resolution Center serves as the Mediation-Court Coordinator
for the 22nd, 23rd, and 25th judicial districts. This program allows
the courts in our area to refer any appropriate case to a mediation
orientation session with mediation being free of cost to the parties.
The referral can be made directly by a judge, by an attorney, or any
parties involved. For more information visit the Supreme Court’s
Website at www.courts.state.va.us.
